Terms of Service

These Terms of Service ("Terms") govern your use of ServiceSnap ("Service", "we", "us", "our"), a SaaS platform operated by ServiceSnap, accessible at servicesnap.ai. By creating an account or using our Service, you agree to these Terms in full. If you do not agree, do not use the Service.
1. Service Description
ServiceSnap provides digital menu creation, QR code generation, AI-powered food photo enhancement, AI-generated menu descriptions, online ordering, queue display, and related tools for businesss and food businesses ("Merchants"). End customers ("Customers") may interact with Merchant menus and place orders through the Service.
2. Account Registration
You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years old to use the Service. You must notify us immediately of any unauthorized use of your account.
3. Subscription Plans & Billing
- Starter Plan: Free, with limited features. No credit card required.
- Paid Plans (Pro, Business): Billed monthly via Stripe. Prices are listed on our pricing page and may change with 30 days' notice.
- Free Trials: Paid plans may include a free trial period. You will be charged at the end of the trial unless you cancel before it ends.
- Cancellation: You may cancel at any time. Paid features remain active until the end of your current billing period, then your account reverts to the Starter plan. No refunds for partial months.
- Promo Codes: Subject to specific terms and may be revoked at any time.
4. Payment Processing (Stripe Connect)
If you enable online ordering (Business plan), customer payments are processed through Stripe via Stripe Connect. By using this feature:
- You agree to Stripe's Connected Account Agreement and Stripe Services Agreement.
- You are the merchant of record for food orders. ServiceSnap is not a party to transactions between you and your customers.
- Standard payment processing fees (Stripe's fees plus a platform service fee) apply to each transaction.
- You are solely responsible for collecting and remitting applicable sales taxes on food orders.
- Chargebacks and disputes on food orders are your responsibility as the merchant of record.
- ServiceSnap may suspend ordering features if your account has excessive chargebacks or fraudulent activity.
5. AI-Generated Content
Our Service uses artificial intelligence to generate and enhance food photos, menu descriptions, business insights, upsell suggestions, and translations. Regarding AI-generated content:
- No Guarantees of Accuracy: AI-generated content may contain errors, inaccuracies, or inappropriate content. You are responsible for reviewing and approving all AI-generated content before publishing.
- Not Professional Advice: AI business insights and suggestions are for informational purposes only and do not constitute professional, financial, legal, or dietary advice.
- Allergen Disclaimer: AI-generated descriptions and dietary tags are not guaranteed to be accurate. You are solely responsible for ensuring allergen information, ingredient lists, and dietary classifications displayed on your menu are correct. ServiceSnap is not liable for allergic reactions, illness, or injury resulting from inaccurate menu information.
- Image Ownership: AI-enhanced photos are derived from images you upload or generate. You grant us a license to process these images. You retain ownership of your original photos. AI-generated images may not be identical to your actual food products.
- Usage Limits: AI features are subject to monthly usage limits based on your plan.
6. Your Content & Data
- You retain ownership of all content you upload (photos, services, descriptions, logos).
- You grant ServiceSnap a non-exclusive, worldwide license to use, display, and process your content solely for the purpose of providing the Service.
- You represent that you have the right to upload all content and that it does not infringe on any third party's intellectual property rights.
- We may use anonymized, aggregated data for analytics and service improvement.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload content that is defamatory, obscene, or infringes on others' rights
- Attempt to gain unauthorized access to the Service or other users' accounts
- Use the Service to transmit malware or engage in phishing
- Resell or redistribute the Service without our written consent
- Scrape, crawl, or use automated means to access the Service beyond normal usage
- Misrepresent your services, prices, ingredients, or allergen information
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MENUFLOW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of revenue, profits, or business arising from Service downtime, errors, or interruptions
- Loss of data, including services, photos, customer orders, settings, or any other data stored in the Service
- Data corruption resulting from software bugs, updates, server failures, or third-party service outages
- Business interruption caused by the Service being unavailable, including inability to display menus, accept orders, or process payments
- Lost customers or missed orders due to QR codes not working, menus not loading, ordering system failures, or payment processing errors
- Inaccurate AI-generated content, including wrong descriptions, incorrect translations, misleading photos, or faulty business insights
- Allergic reactions, illness, or injury resulting from inaccurate menu information, dietary tags, ingredient descriptions, or allergen classifications — whether entered manually or generated by AI
- Payment processing failures, including failed transactions, delayed payouts, held funds, chargebacks, or Stripe account issues
- Third-party service outages, including Stripe, Firebase, Google, AI providers, or any other services ServiceSnap relies on
- Security breaches resulting from attacks on the Service or your account
- Actions taken by your customers, including fraudulent orders, chargebacks, or disputes
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Data will not be lost or corrupted
- AI-generated content will be accurate, appropriate, or free of errors
- The Service will meet your specific business requirements
- Defects will be corrected in any particular timeframe
10. Indemnification
You agree to indemnify, defend, and hold harmless ServiceSnap and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your menu content, including allergen information, pricing, and descriptions
- Disputes with your customers regarding orders, food quality, or allergies
- Your failure to comply with applicable laws, including food safety, tax, and health regulations
- Any third-party claims related to your use of the Service
11. Data Backup
While we take reasonable measures to protect your data, you are solely responsible for maintaining backups of your services, photos, and business data. ServiceSnap is not responsible for data loss due to any cause, including but not limited to server failures, software bugs, account deletion, or third-party service outages. We recommend regularly exporting your menu data.
12. Service Modifications & Termination
- We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.
- We may terminate your account for violation of these Terms, with notice when practicable.
- Upon termination, your right to use the Service ceases. We may delete your data after 30 days.
- Sections 8, 9, 10, and 13 survive termination.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits or class-wide arbitration.
14. Changes to Terms
We may update these Terms at any time. Material changes will be communicated via email or in-app notice at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
